Escaping Domestic Violence Act
Ottawa-area MPP Yasir Naqvi recently introduced a Private Member’s Bill – Bill 53 Escaping Domestic Violence Act. The Bill amends the Residential Tenancies Act, to shorten the period of notice required to terminate a tenancy in cases where the tenant or a dependent child of the tenant is a victim of domestic violence. ACTO believes that the bill can be made stronger, both to protect tenants’ rights and to better protect victims of violence. Currently under the bill, a victim of domestic violence who wishes to terminate a tenancy early must show proof of a restraining order or police investigation. We will propose that the documentation required conform to the special priority applications under the Social Housing Reform Act, which would allow for letters from doctors, social workers and community legal workers to provide this proof.
